Federal Student Loan Discharge For AES Guaranteed Educational Loans

Your Federal education loan may qualify for loan discharge if the loan was issued under the following conditions:

If your loan is discharged, you will not owe any more payments on the loan and you will get a refund of payments you have made on the loan. Also, if the loan is discharged, the lender will tell credit-reporting agencies that the loan has been discharged and any adverse credit history resulting from nonpayment of the discharged loan should be deleted. In addition, you may be eligible to apply for future federal student financial aid.

Closed School Information

You may be able to have your federal student loan debt discharged if your school closed while you were enrolled. You may qualify for loan discharge if you could not complete the program of study for which the loan was intended because the school closed. You must have been attending school within 90 days of the closure date or on an approved leave of absence when the school closed.

How to Obtain Academic and Financial Aid Records
If you are trying to locate your records from a closed school, you should contact the state licensing agency in the state in which the school was located to ask whether the state made arrangements to store the records. Academic and financial aid records may be useful in substantiating your claim for a loan discharge. You may need your academic records if you plan to attend another school and wish to have your course work at the closed school taken into consideration.

Additional Information
Your loan cannot be discharged:

  • If you have completed the program of study through a teach-out or by transferring academic credits or hours earned from the closed school to another school.
  • Because of personal circumstances that caused you to withdraw more than 90 days before the school closed.
  • If you are completing a comparable educational program at another school. If you complete a comparable program of study at another school after your loan is discharged, you may have to pay back the amount of the discharge.
  • If you have not received a diploma or certificate but have completed all of the course work for the program.

False Certification of Ability to Benefit Information

You may qualify for loan discharge if the school that you attended falsely certified your ability to benefit from the education. In order to permit a student to borrow a Federal Family Education Loan Program loan, a school is required to certify that students who lack a high school diploma or GED have the ability to benefit from the training offered by the institution.

False certification of a student's eligibility occurs, for example, if the school failed to test the student's ability to benefit or conducted testing in an improper manner.

You may also be eligible if, at the time of enrollment, you had a physical condition, mental condition, or legal status or condition that would legally bar employment in your field of study.

Unpaid Refund Information

You may qualify for a partial unpaid refund loan discharge of your student loan if your school failed to pay a tuition refund required under federal law if you withdrew during the refund period published by the school. Only the amount of the unpaid refund will be discharged. You may qualify for this refund whether the school is closed or opened.

Spouses and Parents of 9/11/01 Victims Information

You may be able to have your federal student loan debt discharged if you are the spouse or parents of eligible public servants and other eligible victims of the September 11, 2001 terrorist attacks. If your spouse or son/daughter was an eligible public servant or eligible victim who died or became permanently and totally disabled due to injuries suffered in the terrorist attacks on September 11, 2001, you may be eligible to have loans made under the Federal Family Education Loan Program, the Federal Perkins Loan Program, and/or the William D. Ford Federal Direct Loan Program discharged by the United States Department of Education.
